Common questions

Do I have to talk to the police?

No. You must identify yourself, and nothing more. Politely say you want a lawyer and stop talking. Anything you say, even to explain, is evidence.

What happens after a DWI arrest in New Jersey?

DWI is handled in municipal court with no jury, and a conviction cannot be expunged. Penalties include license loss, an ignition interlock and fines, and they climb sharply on a second offense. The evidence, the stop and the breath test procedure are where these cases are won.

Will this stay on my record?

Dismissals and many disorderly persons offenses can be expunged after a waiting period. Indictable crimes have longer waits and some can't be cleared. DWI is never expungeable. We tell you the realistic record outcome on the first call.

What's the difference between a disorderly persons offense and an indictable crime?

Disorderly persons offenses are handled in municipal court with up to six months in jail. Indictable crimes (New Jersey's felonies) go to Superior Court and carry prison time. Downgrading a charge is often the real fight.

Can the charges be dismissed?

Sometimes. Illegal stops and searches, unreliable tests, missing witnesses and weak evidence all lead to dismissals or downgrades. Pre-trial intervention is also available for many first offenses.

Should I take the first plea offer?

Not before a lawyer reviews the evidence. First offers are rarely the best offers, and some pleas carry consequences for licenses, immigration status and jobs that prosecutors don't mention.

What does a defense lawyer cost?

The consultation is free. Fees depend on the charge and the court, and we explain them plainly before you decide. Most cases are flat fee, so you know the number up front.
